TERMS OF USE

1. Our Role

JusBooking is an online travel platform. We act as an intermediary between you and the Property. The accommodation contract for your stay is between you and the Property, which is solely responsible for the rooms, facilities, meals, services and standards it provides, and for honouring confirmed bookings.

We are responsible for operating the platform, transmitting your booking to the Property, and providing the booking confirmation, cancellation and support features described in these Terms.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Indian law. Properties may set their own minimum check-in age and may require a valid government-issued photo identity document for every guest at check-in. Some Properties apply additional local restrictions; where these are known to us, they are shown on the Property page before you book.

3. Searching and Booking

• Prices and availability shown are for the dates, number of rooms and number of guests you enter, and can change until your booking is confirmed.
• You must enter the correct number of adults and children, and the correct age of each child. Occupancy limits, extra-guest charges and child pricing depend on these details. Guests beyond the declared occupancy may be refused or charged by the Property.
• You are responsible for the accuracy of the guest name, mobile number and email you provide. We use them to send your confirmation and to let you manage your booking.
• Special requests are passed to the Property but are not guaranteed and form no part of your booking unless the Property confirms them.

4. Booking Confirmation

Every booking receives a unique booking reference. A booking is either confirmed immediately or held as pending while the Property reviews it, depending on the Property.

• Confirmed — the Property has accepted your booking and must honour it.
• Pending — awaiting the Property’s acceptance. Your room is not secured until it is confirmed.
• Declined — the Property was unable to accept the booking. You are not charged.
• Cancelled — cancelled by you, by the Property, or by JusBooking under these Terms.

Your confirmation voucher sets out the Property details, dates, room and rate plan, guest name, inclusions, total price and the cancellation policy that applies. Please check it and tell us promptly if anything is wrong.

5. Prices, Taxes and Payment

• Prices are shown per stay for the guests and rooms you selected, and include applicable taxes as displayed in the price breakdown. Rates may differ from night to night.
• Charges for services not booked through us — meals outside your rate plan, early check-in, late check-out, extra beds, pets, minibar, laundry, damages or local levies — are payable directly to the Property.
• Where your booking is on a Pay at Hotel rate, no payment is taken by JusBooking at the time of booking. You pay the Property directly, and the Property may ask for a valid identity document or a security deposit at check-in.
• If a price is displayed in error due to an obvious technical or pricing fault, we may cancel the affected booking and refund any amount collected. We will tell you as soon as we can.

6. Cancellation Policy

The cancellation policy is set by the Property for each rate plan and is shown before you book and again on your confirmation. It is the policy attached to your booking that applies. Common policies include:

• Free cancellation until check-in, or until 24, 48 or 72 hours before check-in, depending on the rate plan.
• Non-refundable — the booking cannot be cancelled free of charge at any point after it is made.
• Custom policies set by the Property, shown on the rate plan.

Where a cancellation falls outside the free window, the Property may retain a penalty — typically the cost of the first night, 50% of the booking amount, or 100% of the booking amount, as stated on your rate plan. Not arriving without cancelling (a no-show) may attract a separate charge set by the Property.

Cancellation deadlines are calculated in the Property’s local time zone. Once the check-in date has arrived, bookings can no longer be cancelled online and you should contact the Property directly. Where a booking covers several rooms, you may be able to cancel individual rooms, and the remaining booking is recalculated.

7. Changes to a Booking

Requests to change dates, room type or guest details are subject to availability and to any difference in price. A change may be treated as a cancellation and rebooking under the Property’s policy, and the cancellation terms of the new booking may differ. Confirmed bookings are not affected by later changes to publicly displayed rates.

8. Check-in and Conduct at the Property

• Check-in and check-out times are set by the Property and shown on the Property page and your voucher.
• Each guest may be required to present valid photo identity at check-in. The Property may refuse entry where identity cannot be verified or where its stated policies are not met.
• You are responsible for the conduct of everyone in your booking and for any loss or damage caused during the stay, which the Property may recover from you directly.
• Property rules — including policies on pets, smoking, visitors and events — apply to your stay and are shown on the Property page.

9. Reviews and Guest Content

Reviews may be submitted only for stays actually booked through JusBooking, and must be your own honest experience. We may decline to publish or may remove content that is unlawful, abusive, misleading, discriminatory, promotional, or that discloses another person’s private information. By submitting content you grant us a non-exclusive, royalty-free licence to display it on our platform, alongside the Property it relates to.

10. Your Account

You may book as a guest or through an account. You are responsible for keeping your account and any one-time passwords secure and for activity carried out through them. Booking links we send you give access to that booking, so please do not share them. Tell us promptly if you believe your account or a booking link has been misused. Member pricing, where offered, applies only while you are signed in to an eligible account.

11. Acceptable Use

You agree not to:

• Make speculative, false or fraudulent bookings, or bookings in someone else’s name without their authority.
• Scrape, crawl, copy or republish our content, pricing or availability data, or use automated means to access the platform.
• Interfere with the platform’s security or operation, or attempt to gain unauthorised access to it.
• Use the platform for unlawful activity, harassment or fraud.

12. Intellectual Property

The JusBooking name, logo, platform, software and content are owned by JusBooking Technologies LLP or its licensors. Property descriptions, photographs and other materials supplied by Properties remain theirs. You may use the platform only for personal, non-commercial travel planning and booking.

13. Availability of the Platform

We work to keep the platform accurate and available, but it is provided on an “as is” and “as available” basis. Property descriptions, images, amenities and guest ratings are supplied largely by Properties, and we do not warrant that they are complete or error-free. We may suspend or withdraw parts of the platform for maintenance or operational reasons.

14. Limitation of Liability

To the fullest extent permitted by law:

• JusBooking is not liable for the acts or omissions of a Property, including the quality of the accommodation, refusal of entry, overbooking, or loss, injury or damage occurring during your stay.
• We shall not be liable for indirect, incidental, consequential, punitive or special damages, including loss of profits, data or goodwill.
• Our aggregate liability in connection with a booking shall not exceed the total amount payable to JusBooking for that booking.

Nothing in these Terms limits any liability that cannot be excluded under applicable law, including your rights under the Consumer Protection Act, 2019.

15. Indemnity

You agree to indemnify and hold harmless JusBooking Technologies LLP, its employees, directors and agents from claims, damages or expenses arising from your use of the platform, your stay, or your breach of these Terms or applicable law.

16. Force Majeure

Neither JusBooking nor the Property is liable for failure to perform due to events beyond reasonable control, including natural disasters, epidemics, strikes, civil unrest, government action, network or power failures.

17. Suspension and Termination

We may suspend or close your access where we reasonably believe these Terms or applicable law have been breached, or where we detect fraud or misuse. You may stop using the platform at any time. Bookings already confirmed remain governed by the cancellation policy that applied to them.

18. Privacy

Our Privacy Policy explains how we collect and use your personal data, including the details we share with the Property to complete your booking.

19. Grievance Redressal

If you have a complaint about a booking or about our platform, please contact us using the details below. We aim to acknowledge complaints within 48 hours and to resolve them within the timelines prescribed under applicable Indian law. Complaints relating to the accommodation itself may need to be taken up with the Property, and we will assist where we can.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to any non-waivable consumer rights, the courts at Udaipur, Rajasthan, India have exclusive jurisdiction.

21. Changes to These Terms

We may update these Terms from time to time. The version in force when you make a booking governs that booking. Continued use of the platform indicates acceptance of the updated Terms.
